Anita Li is powered by Shopify, which enables us to provide the Services to you.

When you place an order, you are making an offer to purchase. Anita Li reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until Anita Li confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Anita Li may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made.
Your purchases are subject to return or exchange solely in accordance with our Refund Policy.
You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.

SECTION 4 - PRICES, BILLING, AND CURRENCY CONVERSIONS
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges.
Prices posted in our online stores may be different from prices offered in physical stores or in online or other stores operated by third parties. We may offer, from time to time, promotions on the Services that may affect pricing and that are governed by terms and conditions separate from these Terms. If there is a conflict between the terms for a promotion and these Terms, the promotion terms will govern.
You agree to provide current, complete and accurate purchase, payment and account information for all purchases made at our stores. You agree to promptly update your account and other information, including your email address, credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.

Through Shopify Markets, product prices may be displayed and processed in your local currency. Exchange rates fluctuate daily. In the event of a permitted refund or order cancellation, all refunds will be issued in the exact currency and dollar amount used at the time of purchase. We are not responsible for any differences in the final refunded amount caused by changes in foreign exchange rates or international bank fees.

SECTION 5 - SHIPPING RISKS, DELIVERIES, AND INTERNATIONAL CUSTOMS
We are not liable for shipping and delivery delays. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by shipping carriers, customs processing, or events outside our control. All physical orders are shipped "FOB Shipping Point." This means that the risk of loss, damage, and title for the art prints passes to you the moment we hand the package over to the shipping carrier (e.g., USPS, FedEx, DHL). We are not responsible for transit delays, lost packages, or theft after delivery. Any claims for transit damage or non-delivery must be handled through the shipping carrier. If a package is lost or damaged in transit, we may choose to send a replacement print as a strict customer service courtesy at our sole and absolute discretion; doing so does not waive our rights or constitute an admission of legal liability or responsibility for the carrier's failure. For international orders, you (the buyer) are considered the "Importer of Record" and are solely responsible for all customs clearance fees, import duties, tariffs, and local taxes (such as VAT or GST) imposed by your destination country. These additional charges are not included in our print or shipping prices and must be paid by you directly to your country's customs office or courier to release your package. We are not liable for packages abandoned, destroyed, or delayed due to unpaid international customs fees.

SECTION 6 - INTELLECTUAL PROPERTY AND COPYRIGHT NOTICE

Our Services, including but not limited to all trademarks, brands, text, displays, images, graphics, product reviews, video, and audio, and the design, selection, and arrangement thereof, are owned by Anita Li, its affiliates or licensors and are protected by U.S. and foreign patent, copyright and other intellectual property laws.
These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Services without our prior written consent.
The purchase of any physical art print does not grant the buyer any copyright, reproduction rights, or commercial exploitation rights to the artwork. All images, designs, and content on this website are the sole intellectual property of Anita Li. Scanning, digitally reproducing, altering, or reselling copies of these prints is strictly prohibited. Unauthorized use of the Services may be a violation of federal and state intellectual property laws. All rights not expressly granted herein are reserved by Anita Li.
Anita Li's names, logos, product and service names, designs, and slogans are trademarks of Anita Li or its affiliates or licensors. You must not use such trademarks without the prior written permission of Anita Li. Shopify's name, logo, product and service names, designs and slogans are trademarks of Shopify. All other names, logos, product and service names, designs, and slogans on the Services are the trademarks of their respective owners.

SECTION 7 - OPTIONAL TOOLS
You may be provided with access to customer tools offered by third parties as part of the Services, which we neither monitor nor have any control nor input.
You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.
Any use by you of the optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).
We may also, in the future, offer new features through the Services (including the release of new tools and resources). Such new features shall also be deemed part of the Services and are subject to these Terms of Service.

To the maximum extent permitted by applicable law, in no event shall Anita Li, our directors, officers, employees, or affiliates be liable for any indirect, incidental, punitive, special, or consequential damages of any kind, arising out of or in connection with our products, storefront, or website. Our total liability to you for any claims, damages, losses, or causes of action arising out of your purchase of any physical art print shall be strictly limited to, and shall not exceed, the total dollar amount actually paid by you to us for that specific product.

SECTION 10 - DISPUTE RESOLUTION, WAIVER OF CLASS ACTIONS, AND FINALITY OF CLAIMS
Any dispute or claim relating in any way to your purchase of our art prints must be resolved on an individual basis. You explicitly waive any right to bring or participate in a class action lawsuit, class-wide arbitration, or any other consolidated or representative proceeding.
Furthermore, any final resolution of a dispute—whether through an agreed settlement, arbitration, or a court judgment—shall act as a complete and permanent bar to any future lawsuits or claims by you based on the same factual events or transaction. You may not sue or bring claims against us multiple times for the same purchase or issue.
To the extent permitted by law, any small claims action brought by you must be filed and heard exclusively in a court of competent jurisdiction within Santa Clara County, California, USA. You agree that any out-of-state small claims filings brought against us in an improper jurisdiction shall be subject to immediate dismissal upon our request.

SECTION 11 - GOVERNING LAW, JURISDICTION, AND INTERNATIONAL ACCESS
These Terms of Service and any separate agreements whereby we provide you products shall be governed by, and construed in accordance with, the laws of the State of California, United States, without regard to its conflict of law principles. You explicitly agree that any legal action, dispute, or lawsuit arising out of or relating to your purchase must be filed exclusively in the state or federal courts located in Santa Clara County, California, United States. You hereby waive any objection to venue or personal jurisdiction in these courts. If you access our website or purchase prints from outside the United States, you are entirely responsible for compliance with your own local laws.

SECTION 12 - SEVERABILITY
If any provision of these Terms of Service is determined by a court of competent jurisdiction to be unlawful, void, or unenforceable, that specific provision shall be deemed severed from these Terms, and it shall not affect the validity and enforceability of any remaining provisions.
